Terms of Service
Effective Date: [Insert Date] Last Updated: [Insert Date]
Welcome to Belvere. These Terms of Service ("Terms") govern your access to and use of the website belvere.com, our mobile applications, and all related services, content, features, and products offered by Belvere (collectively, the "Site" or "Services").
Please read these Terms carefully. By accessing, browsing, or purchasing from the Site, you agree to be bound by these Terms, our Privacy Policy, our Return & Refund Policy, and our Shipping Policy, each incorporated by reference. If you do not agree to these Terms, you must not access or use the Site.
1. Definitions
For the purpose of these Terms:
- "Belvere", "we", "our", or "us" refers to [Belvere Legal Entity Name], a [State/Country] [corporation / société] with its registered office at [Registered Address].
- "Client", "you", or "your" refers to any individual accessing or using the Site, whether as a visitor or as a registered customer.
- "Content" refers to all text, images, photographs, videos, illustrations, designs, logos, trademarks, audio, software, and any other material made available through the Site.
- "Order" refers to any purchase request submitted by a Client through the Site.
- "Products" refers to all merchandise offered for sale on the Site.
2. Eligibility
To use the Site or place an Order, you must:
- Be at least 18 years of age or have reached the age of majority in your jurisdiction of residence, whichever is greater;
- Have the legal capacity to enter into a binding contract;
- Provide accurate, current, and complete information during registration and at checkout;
- Use the Site only for personal, non-commercial purposes, unless expressly authorized by Belvere in writing.
The Site is not intended for use by minors. Belvere does not knowingly collect personal information from individuals under 18 years of age. If you believe a minor has provided us with personal information, please contact clientcare@belvere.com.
3. Account Registration
You may browse the Site without creating an account, but certain features (including order history, saved addresses, and wishlists) require account registration.
When creating an account, you agree to:
- Provide accurate, current, and complete information;
- Maintain the confidentiality of your password and login credentials;
- Notify Belvere immediately of any unauthorized use of your account;
- Accept full responsibility for all activities that occur under your account.
Belvere reserves the right to suspend, restrict, or terminate any account that violates these Terms, contains inaccurate information, or is associated with fraudulent activity.
4. Products, Pricing & Availability
4.1 Product Descriptions
Belvere endeavors to describe its Products as accurately as possible. However, due to the handcrafted nature of certain pieces and the variability of natural materials (leather grain, gemstone color, wood patina, marble veining), slight variations between Products and online imagery may occur and are inherent to the artisanal character of the Maison. Such variations do not constitute defects.
Colors, dimensions, and finishes displayed on the Site may also vary depending on your screen settings, device, and lighting conditions.
4.2 Pricing
All prices are displayed in the currency of the destination market and are exclusive of any applicable shipping charges, duties, taxes, or VAT, unless explicitly stated otherwise at checkout.
Belvere reserves the right to modify prices at any time, without prior notice. The price applicable to your Order is the price displayed at the time of order confirmation.
In the event of an obvious pricing error (e.g., a price that is significantly lower than the market value of the Product, or a typographical error), Belvere reserves the right to cancel the Order and issue a full refund, even after order confirmation.
4.3 Availability
All Products are offered subject to availability. Belvere reserves the right, at its sole discretion, to:
- Limit the quantity of any Product available for purchase;
- Discontinue any Product at any time, without prior notice;
- Restrict sales to certain geographic regions or to specific Clients.
5. Orders & Acceptance
5.1 Order Placement
Placing an Order constitutes a binding offer to purchase the selected Product(s) under these Terms. Submission of an Order does not constitute acceptance by Belvere.
5.2 Order Acceptance
A contract of sale is formed only when Belvere sends a Shipping Confirmation email indicating that the Product has been dispatched. Until that moment, Belvere reserves the right, at its sole discretion, to accept, decline, or cancel any Order, including (without limitation) for the following reasons:
- Product unavailability or stock-keeping error;
- Incorrect, incomplete, or fraudulent information provided by the Client;
- Failure to pass identity, address, or payment verification;
- Suspected unauthorized resale or commercial reselling intent;
- Restrictions imposed by export, import, or sanctions laws;
- Pricing or descriptive errors on the Site;
- Pattern of excessive returns or abusive behavior on prior Orders.
5.3 Quantity Limits
Belvere may, at its sole discretion, limit the number of units of any Product that may be purchased per Client, per household, per payment method, or per shipping address, in order to preserve product availability for genuine customers and to deter unauthorized resale.
5.4 Anti-Resale Policy
Products purchased on the Site are intended for personal use only. Purchases made for the purpose of unauthorized resale, including but not limited to resale on third-party marketplaces, are strictly prohibited and may result in Order cancellation, account termination, and legal action.
6. Payment
6.1 Accepted Payment Methods
Belvere accepts the payment methods listed at checkout, which may include major credit and debit cards, Apple Pay, Google Pay, PayPal, and other secure payment services. All payments must be made in the currency displayed at checkout.
6.2 Authorization & Charging
By submitting an Order, you authorize Belvere (or its payment processor) to verify and charge your payment method for the total amount of the Order, including taxes, shipping, and any applicable fees.
If your payment is declined or cannot be verified, Belvere reserves the right to cancel the Order without further notice.
6.3 Fraud Prevention
For your protection and ours, Belvere uses fraud-detection tools and may request additional documentation (such as proof of identity, proof of address, or a copy of the front of the payment card with sensitive digits redacted) before dispatching high-value Orders. Failure to provide such documentation within a reasonable time may result in Order cancellation.
6.4 Taxes
You are responsible for all applicable taxes, duties, customs fees, and import charges relating to your Order, except where these are clearly displayed and collected at checkout (DDP shipments).
7. Shipping & Risk of Loss
Shipping terms, methods, and timelines are set forth in our Shipping Policy, which forms an integral part of these Terms.
Risk of loss and title for Products pass to the Client upon delivery to the address provided at checkout, except where local consumer law provides otherwise. Belvere recommends shipping to a secure address where signature upon delivery can be provided.
If a parcel is returned to Belvere due to an incorrect address, refusal of delivery, or failure to collect within the carrier's holding period, the Client will be charged for return shipping costs, which may be deducted from any refund due.
8. Returns, Exchanges & Refunds
All returns, exchanges, and refunds are governed by our Return & Refund Policy, which forms an integral part of these Terms. Please consult that policy before initiating a return.
This does not affect any non-waivable statutory rights applicable in your jurisdiction (see Section 19).
9. Intellectual Property
9.1 Belvere's Rights
All Content available on the Site — including but not limited to the "Belvere" name, logos, trademarks, service marks, designs, product designs, photographs, illustrations, videos, text, graphics, layouts, and software — is the exclusive property of Belvere or its licensors, and is protected by international copyright, trademark, design, and other intellectual property laws.
Nothing on the Site shall be construed as granting any license or right to use any Content, trademark, or design without Belvere's prior written consent.
9.2 Limited License to You
Belvere grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for personal, non-commercial purposes only.
You may not:
- Reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any Content;
- Use any Belvere trademark, design, or product image in connection with any product or service that is not Belvere's;

- Frame, mirror, or replicate the Site or any portion thereof;
- Reverse-engineer, decompile, or disassemble any software available on the Site.
9.3 Anti-Counterfeit Notice
Belvere actively monitors and enforces its intellectual property rights worldwide. The manufacture, distribution, sale, or purchase of counterfeit Belvere goods is a criminal offense and will be prosecuted to the fullest extent of the law.
10. User Content
10.1 Submissions
By submitting any review, comment, photograph, video, testimonial, suggestion, or other content ("User Content") to the Site or to Belvere's social media channels, you grant Belvere a perpetual, worldwide, royalty-free, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media, in connection with Belvere's marketing, communication, and commercial activities, without any obligation of compensation.
10.2 Representations
You represent and warrant that any User Content you submit:
- Is original to you, or that you have obtained all necessary rights and permissions to grant the license above;
- Does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights;
- Is not unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable;
- Does not contain viruses, malware, or any harmful code.
10.3 Right to Remove
Belvere reserves the right, at its sole discretion, to monitor, edit, refuse, or remove any User Content at any time, without prior notice.
11. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any connected systems;
- Use bots, scrapers, automated purchasing tools, or any technology designed to circumvent Order limits or queue systems;
- Engage in any activity that imposes an unreasonable load on Belvere's infrastructure;
- Attempt to acquire products through fraudulent payment methods, stolen credit cards, or chargeback abuse;
- Resell Belvere Products without prior written authorization;
- Violate any applicable local, national, or international law or regulation.
Violation of this Section may result in immediate account termination, Order cancellation, denial of service, and civil or criminal action.
12. Promotional Codes, Gift Cards & Offers
12.1 Promotional Codes
Promotional codes are valid for a limited time, are subject to specific terms communicated at issuance, and may not be combined with other offers or promotions unless explicitly stated. Promotional codes have no cash value, are non-transferable, and may not be resold.
Belvere reserves the right to cancel any Order placed using a promotional code obtained fraudulently, in violation of its terms, or through unauthorized channels.
12.2 Gift Cards
Gift cards are issued in the currency of purchase, are non-refundable, non-transferable, and may not be redeemed for cash (except where required by applicable law). Gift cards are valid for 24 months from the date of issuance.
Lost or stolen gift cards will not be replaced. Gift cards must be redeemed exclusively on belvere.com.
13. Privacy & Data Protection
Your use of the Site is also governed by our Privacy Policy, which describes how Belvere collects, uses, stores, and protects your personal information in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), the UK GDPR, and the California Consumer Privacy Act (CCPA), as applicable.
By using the Site, you consent to the data practices described in our Privacy Policy.
14. Third-Party Links & Services
The Site may contain links to third-party websites, services, or content (including social media platforms, payment processors, and shipping carriers). Such links are provided for convenience only.
Belvere does not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party site or service. Your interaction with any third party is at your own risk and subject to that party's terms and policies.
15. Disclaimers
Except as expressly required by applicable law:
- The Site and all Content are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied;
- Belvere disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law;
- Belvere does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Belvere does not warrant that any defects in the Site will be corrected.
This Section does not limit any non-waivable warranty granted to consumers under applicable law.
16. Limitation of Liability
To the maximum extent permitted by applicable law:
- Belvere, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Site or the Products;
- Belvere's total aggregate liability to you for any and all claims arising from or relating to these Terms, the Site, or the Products shall not exceed the total amount paid by you for the Product(s) giving rise to the claim during the twelve (12) months preceding the event;
- Nothing in these Terms shall exclude or limit Belvere's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by applicable law.
Some jurisdictions do not allow the limitation or exclusion of certain damages, in which case the above limitation will apply only to the extent permitted by law.
17. Indemnification
You agree to indemnify, defend, and hold harmless Belvere, its affiliates, officers, directors, employees, and agents from and against any claim, demand, damage, loss, liability, or expense (including reasonable attorneys' fees) arising out of:
- Your breach of these Terms;
- Your violation of any law or regulation;
- Your infringement of any third-party right, including intellectual property and privacy rights;
- Any User Content you submit to the Site.
18. Force Majeure
Belvere shall not be liable for any failure or delay in performing its obligations under these Terms when such failure or delay results from a Force Majeure event, including but not limited to: natural disasters, pandemics, acts of war, terrorism, civil unrest, government actions, embargoes, sanctions, strikes, supply-chain disruptions, transportation failures, or failures of telecommunications or internet networks beyond Belvere's reasonable control.
19. Statutory Consumer Rights
Nothing in these Terms is intended to exclude, restrict, or modify any non-waivable statutory rights that you may have as a consumer under applicable law, including (where applicable):
- The EU 14-day right of withdrawal under Directive 2011/83/EU;
- The UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
- The EU Consumer Sales Directive (EU) 2019/771 on legal guarantee of conformity (2-year minimum);
- US state-level consumer protection statutes;
- Any other mandatory consumer rights granted under the law of your jurisdiction of residence.
Where such statutory rights conflict with these Terms, the statutory rights shall prevail.
20. Termination
Belvere reserves the right, at its sole discretion and without prior notice, to:
- Suspend or terminate your account;
- Restrict or refuse access to the Site;
- Cancel any pending Order;
if you breach these Terms, engage in fraudulent or unlawful activity, or for any other reason Belvere deems necessary to protect its interests, its Clients, or the integrity of the Site.
You may terminate your account at any time by contacting clientcare@belvere.com. Termination of your account does not relieve you of any payment obligations for Orders placed prior to termination.
Sections that by their nature should survive termination (including IP, indemnification, limitation of liability, and dispute resolution) shall survive.
21. Modifications to the Terms
Belvere reserves the right to modify, update, or replace these Terms at any time. Changes will become effective upon posting on the Site, with the updated "Last Updated" date.
For material changes, Belvere will make reasonable efforts to notify Clients by email or by prominent notice on the Site. Your continued use of the Site after the effective date of any change constitutes your acceptance of the revised Terms.
The version of the Terms applicable to a given Order is the version in force at the time the Order is placed.
22. Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the [State of Delaware / State of New York / Country], without regard to its conflict-of-laws principles.
The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction whose consumer protection law grants you the benefit of the mandatory provisions of the law of your country of residence, those provisions shall remain applicable.
23. Dispute Resolution
23.1 Informal Resolution
Before initiating any formal proceeding, the parties agree to attempt in good faith to resolve any dispute informally by contacting Belvere at legal@belvere.com. Most disputes can be resolved at this stage.
23.2 Binding Arbitration (US Clients)
If you are a US-resident Client, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved informally shall be resolved by final and binding arbitration, administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, in [New York, NY] / [Wilmington, DE], in English.
Each party shall bear its own arbitration fees, except as otherwise provided by AAA rules. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
23.3 Class Action Waiver (US Clients)
To the maximum extent permitted by law, US-resident Clients agree that disputes shall be resolved on an individual basis only, and not as a class, collective, or representative action.
23.4 EU Online Dispute Resolution
If you are a consumer residing in the European Union, you have the right to use the European Commission's Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr.
You may also refer the dispute to the consumer mediation body in your country of residence.
23.5 Court Jurisdiction
Subject to Sections 23.2 and 23.4, any dispute that is not subject to arbitration or mediation shall be submitted to the exclusive jurisdiction of the courts of [Jurisdiction], except where mandatory consumer protection law in the Client's country of residence provides otherwise.
24. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
25. Entire Agreement
These Terms, together with the Privacy Policy, the Return & Refund Policy, the Shipping Policy, and any additional terms communicated at checkout, constitute the entire agreement between you and Belvere with respect to your use of the Site and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
26. Assignment
You may not assign or transfer these Terms or any of your rights or obligations hereunder without the prior written consent of Belvere. Belvere may assign or transfer these Terms, in whole or in part, without restriction.
